These Regulations require the notification and marking of sites where there is a total quantity of 25 tonnes or more of dangerous substances present at the site. These Regulations require the notification to the local fire authority and the enforcing authority under the Health and Safety at Work etc Act for any site which houses a total quantity of 25 tonnes or more of dangerous substances.
They also require the display of signs warning of the presence or possible presence of dangerous substances at the access points to any site with a total quantity of 25 tonnes or more of dangerous substances, whether or not the site is excepted from the notification requirements; and allow an inspector to direct the display of signs at locations of dangerous substances at such a site, if necessary.
Exemption certificates9.—(1) Subject to paragraph (2), the Executive may, by certificate in writing, exempt any person or class of persons or any activity or class of activities to which these Regulations apply from any requirement imposed by these Regulations and any such exemption may be granted subject to conditions and to a limit of time and may be revoked by a certificate in writing at any time.(2) The Executive shall not grant any such exemption unless, having regard to the circumstances of the case, and in particular to–(a)the conditions, if any, which it proposes to attach to the exemption, and(b)any other requirements imposed by or under any enactment which apply to the case; it is satisfied that the health and safety of persons who are likely to be affected by the exemption will not be prejudiced because of it.
