The Working Time Regulations create a basic set of rights for the time people work, particularly 28 days paid holidays, a right to 20 minute paid breaks for each 6 hours worked, a right to weekly rest of at least one full 24 hour period, and the right to limit the working week to 48 hours.
First, it sets a default rule that workers may work no more than 48 hours per week (although one may opt out of it). Secondly, it grants a mandatory right to paid annual leave of at least a minimum of 28 days (including bank holidays and public holidays). Thirdly, it creates the right to a minimum period of rest of 20 minutes in any shift lasting over 6 hours.The employee can choose to work more than 48 hours a week on average if they're over 18. This is called 'opting out'. The employer can ask them to opt out, but they can't be sacked or treated unfairly for refusing to do so. The employee can opt out for a certain period or indefinitely. It must be voluntary and in writing.
Example of opt-out agreement: I [worker's name] agree that I may work for more than an average of 48 hours a week. If I change my mind, I will give my employer [amount of time - up to 3 months'] notice in writing to end this agreement. Signed…………………………………… Dated…………………………………….
